Jonas Urba, a New York employment lawyer talks about a 2023 NLRB decision which prohibits silence for severance pay. For decades, employers have required employees to never reapply for jobs with the company they leave and not to say bad things about their former employer after receiving severance. Now, the National Labor Relations Board tells us that’s illegal, against the National Labor Relations Act. Doing so chills employees from unionizing. It interferes with their right to collectively organize. It impairs the improvement of terms and conditions of employment for these and other employees.
